Terms of Service

In short: AgentPhone lets your AI agent use a real iPhone. You're responsible for what your agent does with it. Person-to-person use only: no spam, no bulk or marketing messages, no robocalls, and never without the recipient's consent where the law requires it. The service is in early access and provided as is.
1. Agreement
These terms are an agreement between you and the operator of AgentPhone ("AgentPhone", "we", "us"). By using the website or the service, you accept them. If you use AgentPhone for an organization, you accept them on its behalf and confirm you're authorized to. Our Privacy Policy explains how we handle data.
2. The service
AgentPhone gives AI agents access to physical iPhones that we operate. Through our MCP server, an agent can view a phone's screen, use its apps, and send and read messages from its number. Features marked "pilot" or "coming soon" may change or be withdrawn. The service is in early access: expect changes, interruptions and limits.
3. Accounts and credentials
- You must be at least 18 and able to form a binding contract.
- Keep your API keys and sign-in codes secret. You're responsible for all activity under them. Tell us right away if one is exposed, so we can revoke it.
- Give us accurate account information and keep it current.
4. Your agent, your responsibility
You decide what your agent does. You're responsible for its instructions, its actions on the phone, and every message it sends through AgentPhone, as if you had done them yourself.
Approvals, sending limits and allowlists help you stay in control. They don't guarantee that an agent will behave correctly. AI agents make mistakes, so review what matters.
5. Acceptable use
You may not use AgentPhone, or let your agent use it, to:
- send spam, bulk or unsolicited messages, marketing or promotional campaigns, or telemarketing, or make automated or prerecorded calls ("robocalls");
- contact anyone without the consent the law requires, or keep contacting someone after they ask you to stop (for example by replying STOP);
- break the law, including the Telephone Consumer Protection Act, CAN-SPAM, and laws on consumer protection, privacy and call recording, or break carrier messaging rules (such as CTIA guidelines) or Apple's terms;
- harass, threaten, defraud or deceive anyone, including by impersonating a person or organization or by phishing;
- get around authentication or security on the phone or in any app or account, or access accounts you aren't authorized to use;
- use third-party apps or services in ways their terms don't allow;
- send or store unlawful content, or content that infringes others' rights;
- interfere with the service or other customers' phones, get around limits, or reverse-engineer or probe our systems (except security research we approve in writing).
Where the law requires it, you must tell the people you contact that they're dealing with an AI agent.
6. Limits and enforcement
We set sending limits per phone and per recipient, and we may change them. We may review activity to enforce these terms. We may block an action, pause a phone, or suspend or end your access without notice if we reasonably believe you've broken these terms, or to protect people, our phone numbers or the service.
7. Phones and phone numbers
We own or control the devices and the phone numbers and accounts on them. We assign them to you for your use, and they don't become yours. We may replace, reset or reassign a phone or number (for example for maintenance, security or at the end of your access). You can't port a number away unless we agree in writing.
8. Third-party services
The service depends on others: Apple and iOS, mobile carriers, the apps your agent uses, and the assistant you connect (such as Grok, Muse or Claude). Their terms apply to your use of them. We aren't responsible for their availability, their changes, or what they do with data they receive.
9. Fees
Early access is free unless we agree otherwise in writing. Before any paid plan applies to you, we'll tell you the price and get your agreement.
10. Your content
You own the content you and your agent provide or receive through the service. You give us permission to host, process and transmit it only to provide, secure and support the service, as described in our Privacy Policy. If you send us feedback, we may use it without any obligation to you.
11. Ending your access
You can stop using AgentPhone at any time and ask us to close your account. We may end or suspend access as described in section 6, or when we end early access or discontinue the service, with notice where reasonable. Sections 4, 5, 10 and 12–16 survive termination.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that the service will be uninterrupted or error-free, that messages will be delivered, or that an agent's actions will be correct.
13. Limitation of liability
To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim about the service is limited to the greater of what you paid us in the 12 months before the claim and US $100.
14. Indemnity
You'll defend and indemnify us against third-party claims arising from your use of the service, your agent's actions or messages, or your breach of these terms or of the law.
15. Governing law
These terms are governed by the laws of the State of California, excluding its conflict-of-laws rules. Disputes go to the state or federal courts in San Francisco County, California.
16. Changes and general terms
We may update these terms. We'll post changes here, and notify customers of material changes before they take effect. If you keep using the service after that, you accept the new terms. If any part of these terms is unenforceable, the rest still applies. Not enforcing a right isn't a waiver. You may not transfer these terms without our consent.
